An affidavit, which includes a "certified copy" of a Kenyan birth certificate, has been filed with Judge David Carter of the U.S. District Court for the Central District of California. Carter is scheduled to preside over a hearing on the case on Sept. 8.
The plaintiffs, including former presidential candidate Alan Keyes, hope the judge will order expedited discovery which would open all of the documents Obama has spent hundreds of thousands of dollars to keep sealed.
The "certification of live birth" posted online and widely touted as "Obama's birth certificate" does not in any way prove he was born in Hawaii, since the same "short-form" document is easily obtainable for children not born in Hawaii. The true "long-form" birth certificate – which includes information such as the name of the birth hospital and attending physician – is the only document that can prove Obama was born in Hawaii, but to date he has not permitted its release for public or press scrutiny.
Oddly, though congressional hearings were held to determine whether Sen. John McCain was constitutionally eligible to be president as a "natural born citizen," no controlling legal authority ever sought to verify Obama's claim to a Hawaiian birth.

No controlling legal authority determined that GW Bush was born in Connecticut, Clinton was born in Arkansas, JFK was born in Massachusetts or any president was born anywhere.
Obama was the first US president to show a birth certificate, which is the official birth certificate of the state of Hawaii and is NOT forged (or McCain would have been all over the issue, and so would have been the FBI and the Treasury Department and the police of Hawaii). The facts on the birth certificate that Obama posted and showed to both Polifact and Factcheck were twice confirmed by the officials in Hawaii and there is even a witness that recalls being told of his birth in Hawaii in 1961. Not true. A person born outside of Hawaii cannot obtain a Hawaii birth document that says "born in Hawaii on it." And, at the time Obama was born, it was not possible to register a foreign birth in Hawaii, so the original birth certificate in his file must be from Hawaii.
As the Wall Street Journal commented: "Obama has already provided a legal birth certificate demonstrating that he was born in Hawaii. No one has produced any serious evidence to the contrary. Absent such evidence, it is unreasonable to deny that Obama has met the burden of proof. We know that he was born in Honolulu as surely as we know that Bill Clinton was born in Hope, Ark., or George W. Bush in New Haven, Conn.'
Then, you may ask, why doesn't Obama show the long-form birth certificate. Because Hawaii sends out only the short-form birth certificate (http://www.starbulletin.com/columnists/kokualine/20090606_kokua_line.html)
That being the case, unless Obama has a copy of the original birth certificate sent to his parents, and not lost it as many of us do, then the only birth certificate that he can show is the one that Hawaii sent him, and Hawaii sends out only the short-form Certification.
I am sure that, in the case of the President of the United States, Hawaii can make an exception to this "rule".
Particularly if demanded by the WH.
